Terms of Use

These terms are the agreement between you and Noam Eilon for the use of lucina. They also serve as the end user licence agreement for the app's subscription. By using lucina you accept them.
The app
lucina helps you and a partner choose a baby name by swiping through a name catalogue and surfacing the names you both keep. You may also publish a shortlist to a passcode-protected page so family members can vote.
Your account
You are responsible for keeping your login details secure and for activity on your account. You must be old enough to enter a contract where you live, and at least 13.
Free use
Swiping is free and unlimited. Without a subscription you can keep swiping through the name catalogue for as long as you like: there is no cap and no meter. The lists you build that way are yours, as are the details we hold on each name and the free deck filters — gender, first letter, name length and origin.
Unlimited means we do not count your swipes against an allowance. It does not exempt you from the ordinary request-rate limits that keep the service standing, which are the same for subscribers and non-subscribers.
Subscription
Premium costs $4.99 per month in the US App Store; in other countries Apple shows you the local price before you confirm. One subscription covers both partners in a couple — if either of you subscribes, you both get premium, and you should not buy two.
The subscription automatically renews each month until you cancel. Payment is charged to your Apple ID at confirmation of purchase, and renewal is charged within 24 hours of the end of the current period.
To cancel, open Settings on your iPhone, tap your name, then Subscriptions, and turn off automatic renewal at least 24 hours before the period ends. Cancelling stops future charges; the subscription runs to the end of the period you have already paid for. Because billing is handled by Apple, cancellation and refunds are managed there, not by us. Deleting your lucina account does not cancel your subscription.
A subscription does not buy you more swipes — swiping is already unlimited without one. What it adds is everything beyond swiping on your own: linking with a partner, adding custom names of your own that are not in the catalogue, publishing a family page for relatives to vote on, and the three premium deck filters — popularity, style and syllable count.
Only the partner who creates the couple needs a subscription. Joining one with an invite code is free, and whoever joins becomes premium by joining — that is how one subscription covers two people.
There is no free trial and no annual plan.
If we change the price, we will tell you before it takes effect, and you can cancel if you do not want to continue.
What happens if you unsubscribe
Your matches and lists are not deleted when a subscription ends, and everything you have already swiped on, matched or saved stays available to you. Swiping stays unlimited, because it never depended on the subscription in the first place. What stops is premium: the premium deck filters, starting a new couple, adding or renaming your own custom names, and creating a family page, changing the names on it, generating a new passcode for it, or reopening it after it has been closed.
A couple you are already in survives. You keep your partner, your matches and the lists you share, and neither of you is put back to swiping alone. What you lose is the ability to start a fresh one, so if you leave a couple after your subscription has ended, you cannot create another without subscribing again. Custom names you have already added stay on your list and you can still read them. You can usually remove one as well, but not if you have matched on it, and not if it is on a family page; those two blocks apply to subscribers and non-subscribers alike, because removing such a name would take a match or a relative's votes with it. A name on a family page is the awkward case: taking it off the page needs a subscription, so it stays until you subscribe again or delete the page. What you cannot do at all is add another custom name, or rename one.
A family page you already published stays readable, and the family you shared it with can carry on voting and commenting on it. You can still close it or delete it. You cannot reopen it once it is closed, or change the names or the passcode on it, without subscribing again.
About the name information
Meanings, origins and popularity information in lucina are provided for interest. Names have contested and overlapping histories, and popularity data reflects public records for a particular country and period. Treat it as a starting point for a conversation, not as an authoritative reference.
Family pages
A family page is protected by a passcode and is excluded from search engines, but anyone you give the link and passcode to can open it and can see the names, votes and comments on it. You decide who to share it with. You are responsible for what you and your invited participants post there, and you can delete the page at any time.
Acceptable use
Do not attempt to break, overload or gain unauthorised access to the service, use it to harass anyone, or scrape or redistribute the name catalogue in bulk.
Ending your use
You may delete your account at any time from your profile in the app. Some content you shared with a partner stays with them — the Privacy Policy explains exactly what. We may suspend or close an account that seriously or repeatedly breaks these terms.
Disclaimers and liability
lucina is provided as is. We do not promise that it will always be available or error free. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you is limited to the greater of US$100 and the total amount paid for lucina in the twelve months before the claim. That is the amount paid for the subscription however it reached us — Apple collects it, as described above, so a cap measured only by what you handed us directly would come to nothing.
Apple is not a party to these terms and is not responsible for lucina or for supporting it. Apple is, however, entitled to enforce these terms against you as a third-party beneficiary.
Changes
We may update these terms. If a change is material we will update the date above and tell you in the app. Continuing to use lucina after a change means you accept the updated terms.
